Affiliate Program Agreement

By ticking the acceptance checkbox and completing the affiliate registration at finanzasensuiza.com/afiliados/, you accept the clauses below. This action constitutes a valid simple electronic signature under Swiss law in accordance with the Federal Act on Electronic Signatures (ZertES).
Your application remains in "pending approval" status and will be manually reviewed by Carolina Torras before activation (usual timeframe: 24 to 72 business hours). This prior review is an anti-fraud safeguard protecting both the program and the other affiliates. Carolina reserves the right to reject applications without providing reasons. Until your account is approved and active, no commission may be generated, even if your URL has been shared.
1. Nature of the relationship
You are an independent professional. There is no employment relationship, no employment contract, and no subordination. You promote the services of Finanzas en Suiza freely and are responsible for your own organisation, equipment, expenses and taxes.
2. Commission program (Triple-9 system)
Tier structure
- Starter · 9%: entry level for every new affiliate.
- Active · 18%: upon meeting BOTH requirements in the last 9 months — CHF 1,800 invoiced AND 9 valid sales attributable to your code.
- Master · 27%: upon meeting BOTH requirements in the last 9 months — CHF 4,500 invoiced AND 18 valid sales attributable to your code.
Tier upgrade
The system evaluates the last 9 months of cumulative activity. Once you meet BOTH requirements (CHF invoiced + number of sales) of the next tier, you upgrade instantly.
Tier maintenance (monthly minimum)
- Active: minimum CHF 180 invoiced per calendar month.
- Master: minimum CHF 450 invoiced per calendar month.
Tier downgrade (when maintenance is not met)
- Month 1 below minimum: email notice — "this month you did not reach the minimum. If the next month is also below, you will drop one tier."
- Month 2 consecutively below minimum: you drop one tier on day 1 of the following month. There is no multi-tier drop at once (Master goes to Active, not to Starter).
- To upgrade again, you must once more meet the upgrade requirements.
Attribution cookie
When a client accesses through your URL or code, a 30-day cookie is registered. Any purchase within that window is attributed to you.
3. Commission payment
- When: on the 5th day of each month, for commissions consolidated in the previous month.
- Method: TWINT or bank transfer (IBAN).
- Calculation basis: amount actually collected by Finanzas en Suiza (after any Gutschein discount and before payment gateway fees).
- Refunds: if the end client receives a refund, the corresponding commission is cancelled or offset against future commissions.
- Minimum payout: CHF 80 accumulated. If the minimum is not reached in a given month, the balance carries over to the next month.
4. Anti-fraud rules
To protect the integrity of the program, the following practices are prohibited. Detection leads to immediate deactivation of your account, return of improperly obtained commissions, and possible legal action:
- Self-referral: contracting services using your own code.
- Cookie stuffing: forcing the cookie without a real user click.
- Spam: sending your link through unauthorised channels (mass emails without consent, forums where it is prohibited, etc.).
- Trademark bidding: bidding on Google Ads for the "Finanzas en Suiza" or "Carolina Torras" trademarks.
- False promises: making misleading statements about the services.
- Systematic refunds: orchestrating purchases followed by cancellations.
5. Data protection (Data Processing Agreement — DPA)
The data shown in your affiliate dashboard is confidential information of end clients. To protect this data in accordance with the Swiss Federal Act on Data Protection (FADP, revDSG) and the EU General Data Protection Regulation (GDPR), you undertake to:
- Use the data exclusively to verify your commissions and clarify any discrepancies.
- Not store, copy, export, or retain such data outside the dashboard.
- Not share any data with third parties under any circumstance.
- Not contact end clients identified by their internal reference directly.
- Not combine dashboard data with other sources to re-identify clients.
The dashboard only displays: invoice number (internal accounting reference), service contracted, amount, date and your calculated commission. You will not see end clients' names, emails, phone numbers or addresses. The invoice number is an accounting reference that does not constitute personal data under the FADP and enables commission reconciliation without exposing the client's identity.
Serious breach of these obligations terminates the contract immediately and may give rise to personal liability of the affiliate under the FADP. Minor cases mainly entail deactivation from the program, return of improperly obtained commissions, and possible civil liability for damages. The FADP provides for administrative fines of up to CHF 250,000, reserved for extreme cases of wilful non-compliance.
6. Termination
- Either party may terminate this agreement at any time with written notice of 30 days (email to info@finanzasensuiza.com).
- Commissions accrued before the effective termination date are paid in the next cycle (the 5th).
- Finanzas en Suiza may terminate without prior notice in the event of proven fraud, breach of the DPA, or serious breach of the contract.
- After termination, the affiliate code is deactivated immediately and the cookie no longer attributes new conversions.
7. Tax and legal responsibility
- You are responsible for declaring and paying your own taxes and social security contributions (AHV/IV/EO if you exceed the threshold) on the commissions received.
- Finanzas en Suiza issues an annual statement of commissions paid, available in your dashboard for your tax return.
- You are responsible for complying with the applicable legislation in your jurisdiction when promoting the services.
8. Final provisions
- Amendments: Finanzas en Suiza may update this agreement with 30 days' notice. If you do not accept the changes, you may terminate the agreement without penalty.
- Governing law: this agreement is governed by Swiss law.
- Jurisdiction: any dispute shall be submitted to the courts of Zurich, save for mandatory legal provisions to the contrary.
- Severability: should any clause be invalid, the rest of the agreement remains valid.
- Language of the contract: this agreement is available in German, Spanish, English, French, Italian and Portuguese. The German version is the legally binding one; the other versions are courtesy translations. In the event of any discrepancy or interpretative divergence, the German version shall prevail.
9. Automated operation
The program operates fully automatically through the Finanzas en Suiza technical system. All operational information (account status, commissions, payments, tiers, etc.) is always available in your private affiliate dashboard, which you access with your personal credentials. Strictly necessary technical communications are generated and sent by the system as required, without manual intervention.
