Nature of the agreement. The appointment is a mandate contract under art. 394 et seq. of the Swiss Code of Obligations (CO). Art. 404 para. 1 CO allows either party to revoke the mandate at any time, which is why cancelling in advance never costs anything.
Cancelling too late. Art. 404 para. 2 CO provides that a party who revokes the mandate at an inopportune time is liable for the damage this causes to the other party. An appointment that is not cancelled at least 24 hours in advance leaves a gap in the calendar that can no longer be filled. Art. 97 para. 1 CO governs compensation for non-performance.
El importe, acordado de antemano. Las cantidades no se fijan después: se acuerdan aquí, de forma expresa y previa, al marcar la casilla, conforme a los art. 1 y 2 CO sobre formación del contrato. Son CHF 80.— para una cita de una hora y CHF 62.— para la llamada de quince minutos. En la hora de orientación, que se paga por adelantado, la sesión se considera prestada y el importe no se devuelve.
Paying the invoice. It is issued in the name of Carolina Torras and is due within 30 days. After that deadline, art. 102 CO places the debtor in default and art. 104 para. 1 CO provides for default interest of 5 % a year.
